Mediation summit stuns the HR world

• The Department for Business, Innovation and Skills clears up uncertainty and educates delegates on Government initiatives for improving workplace dispute resolution and mediation.

• National mediation conference with speakers from UK Government, CIPD, BT, Boyes Turner and The TCM Group enjoys great success and a big round of applause.

On 19th of January 2012, The TCM Group in partnership with the Department for Business, Innovation and Skills and the London Chamber of Commerce and Industry hosted a Briefing Seminar on the Government’s response to the ‘Resolving workplace disputes’ consultation. The response states that mediation should become a preferred mechanism for organisations to resolve disputes without the need to go to court.
The prestigious event attracted a large number of HR professionals, journalists and bloggers from all over the UK, curious to find out more specific details about the Governments’ response to the consultation, which includes a pilot mediation network scheme for SMEs in Manchester and Cambridge. The latest media buzz about mediation helped set the record breaking attendance, following two popular articles in the Independent newspaper and Working Mums online magazine.
The impressive array of keynote speakers, including Gail Davis from BIS, talked passionately about mediation and how it has the potential to revolutionise the way workplace disputes are handled by cutting out the lawyers, the tribunals and the courts.
Mediation is a process of dispute resolution during which the parties, with the help of a neutral mediator, work together to secure a constructive and lasting solution to a conflict or dispute.
Mediation is voluntary and confidential. The mediator encourages the parties to share their concerns in a non-blaming manner. Mediators facilitate open and honest dialogue at a time when communication has often broken down. They promote empathy and understanding between the parties and as a result the parties are able to resolve their own differences without need for a solution to be imposed.
Most speakers focused on last year’s number of employment tribunal claims and impressed the delegates by demonstrating the amount of money, time and business focus they can save if mediation was embedded in their alternative dispute resolution strategies.

The TCM Group to host National Mediation Summit

Breakfast Briefing Seminar

On the 19th of January, The TCM Group will be hosting a breakfast briefing seminar on the Government’s response to the ‘Resolving workplace disputes’ consultation. Key speakers will include: Gail Davis, Assistant Director in Dispute Resolution for BIS, representatives from the Department for Business, the legal profession and HR and mediation expert David Liddle.

The Government response to the consultation is part of theEmployment Law Review instigated by the Coalition. On the 30th of November the Coalition Government announced one of the most radical shake-ups of employment law in twenty years. The announcements have received far reaching media coverage, however the government’s increased focus on mediation has gone broadly unmentioned.

It is clear that the Government is serious about mediation and about encouraging companies to resolve disputes without the need for legal remedies. “The government has declared it will continue to work with the mediation industry to embed mediation in the resolution of workplace disputes.” and is now even more convinced about the role that mediation can play, as one of the forms of early dispute resolution.

As stated in the Government Response to Consultation:

“Our vision is for an employment dispute resolution system that promotes the use of early dispute resolution as a means of dealing with workplace problems. The consultation “Resolving Workplace Disputes” set out our ideas, which focused on the need to tackle problems early, before they got to the tribunal stage.”

The Government is planning to explore whether and how big organisations might be able to share their mediation expertise with smaller businesses in their supply chain, and will pilot the creation of regional mediation networks through the provision of mediation training to a number of representatives from local SMEs.

Mediation Success at the Personnel Today Awards

On the 23rd of November at the Park Hilton Hotel in central London, the 2011 Personnel Today Awards took place.

The TCM Group was one of the distinguished sponsors of the event’s awards alongside Delloitte and XpertHR. Eight hundred HR professionals from some of the UK’s best employers joined the event and were entertained by the well-known comedian Jack Dee.

The TCM Group sponsored the brand new ‘Innovation in Dispute Resolution’ award, which was presented by the Minister for employment relations Edward Davey MP. During his speech the minister commented on his passion about mediation and the fact that he believes that mediation can change our working culture.

The HR teams shortlisted for this year’s award were:

·         East Lancashire Primary Care Trust
·         Surrey Country Council
·         Topshop/Topman

The award was presented to the East Sussex County Council that most clearly demonstrated innovation, creativity and commitment in this area, becoming the 2011‘Innovation in Dispute Resolution Award’ winner.
